Resumen: El presente artículo indaga en las representaciones de estudiantes de doctorado en educación respecto de aquellos aspectos que hacen que una investigación sea ética. La muestra estuvo compuesta por 24 estudiantes de doctorado de diversos programas chilenos (60% mujeres), entre 30 y 52 años. El diseño implicó la realización de seis grupos focales y las interacciones se registraron en audio y video. El análisis del corpus se realizó bajo un enfoque cualitativo basado en la Teoría Fundamentada de perspectiva constructivista. (...) Los resultados muestran la coexistencia de dos representaciones diferentes sobre lo ético en la investigación educacional. Cada una de estas representaciones refleja una comprensión y una forma de concebir la realidad en cuanto al rol que tiene la ética en la investigación. Abstract: This article investigates the representations of doctoral students in education regarding those aspects that configure the ethical aspect of scientific research. In this study, participated 24 doctoral students from different Chilean programs (60% women) between 30 and 52 years of age. The design involved six focus groups, and the interactions were recorded in audio and video. The corpus analysis was carried out under a qualitative approach based on Grounded Theory with a constructivist perspective. The results show the coexistence of two different representations of ethics in educational research. Each of these representations reflects an understanding and a way of conceiving reality regarding the role of ethics in research. There seems to be a minimal core that every theory wishing to accommodate the intuition that the future is open must contain: a denial of physical determinism (i.e. the thesis that what future states the universe will be in is implied by what states it has been in), and a denial of strong fatalism (i.e. the thesis that, at every time, what will subsequently be the case is metaphysically necessary).1 Those two requirements are often associated with the idea of an (...) objective temporal flow and the non-reality of the future. However, at least certain ways to frame the “openness” intuition do not rely on any of these. Branching Time Theory (BTT) is one such: it is compatible with the denial that time flow is objective and it is couched in a language with a (prima facie) commitment to an eternalist ontology. BTT, though, urges us to resist certain intuitions about the determinacy of future claims, which arguably do not lead either to physical determinism or to fatalism. Against BTT, supporters of the Thin Red Line Theory (TRL) argue that their position avoids determinism and fatalism, while also representing the fact that there is a future which is “special” because it is the one that will be the case. But starting with Belnap and Green 1994, some have objected to the tenability of TRL, mainly on metaphysical grounds. In particular, those argue that “positing a thin red line amounts to giving up objective indeterminism,”2 and that “has unacceptable consequences, ranging from a mistreatment of actuality to an inability to talk coherently about what would have happened had what is going to happen not taken place.”3 In this paper, we wish to reframe the.. Social science inquiries of American agriculture have long recognized the inextricability of farm households and farm businesses. Efforts to train and support farmers, however, often privilege business realm indicators over social issues. Such framings implicitly position households as disconnected from farm stress or farm success. This article argues that systematically tracing the pathways between farm households and farm operations represents a potentially powerful inroad towards identifying effective support interventions. We argue childcare arrangements are an underrecognized challenge through which farm household (...) dynamics directly influence agricultural production. We draw on interviews and focus group data with farmers in the Northeastern United States to understand how farmer–parents access and negotiate childcare. Farmer–parents value raising children on farms, but express reluctance to expect current or future labor from them. Years with young children thus represent an especially vulnerable phase during a farm’s trajectory. We identify and analyze social, economic, and cognitive pathways through which childcare impacts farm operations. Social pathways include relationship tensions and gendered on-farm divisions of labor; economic pathways include farm layout and structure; cognitive pathways include how farmers think about and plan for their operations. Explicitly acknowledging such issues can better equip farmer–parents to anticipate and plan for conflicting demands on their time. (shrink)

This paper argues that most of the alleged straight solutions to the sceptical paradox which Kripke ascribed to Wittgenstein can be regarded as the first horn of a dilemma whose second horn is the paradox itself. The dilemma is proved to be a by‐product of a foundationalist assumption on the notion of justification, as applied to linguistic behaviour. It is maintained that the assumption is unnecessary and that the dilemma is therefore spurious. To this end, an alternative conception of the (...) justification of linguistic behaviour is outlined, a conception that vindicates some of the insights behind Kripke's Wittgenstein's sceptical solution of the paradox. This alternative conception is defended against two objections (both familiar from McDowell's works): (1) that it would imply that for the linguistic community there is no authority, no standard to meet and, therefore, no possibility of error and (2) that it would lead to a kind of idealism. In recent works, Časlav Brukner and Jacques Pienaar have raised interesting objections to the relational interpretation of quantum mechanics. We answer these objections in detail and show that, far from questioning the viability of the interpretation, they sharpen and clarify it.

In this paper I sketch a systematic reconstruction of Husserl’s fundamental concept of “attitude”. I first explore Husserl’s account with respect to the three faculties of intellect, will, and emotivity [Gemüt], which also define the three basic kinds of attitude. The attitude assumed by the subject plays at this level the important role of articulating and unifying, according to an overall direction, various underlying moments of a complex act. I then focus on the specific intellectual, viz. cognitive attitudes and highlight (...) the difference between the naturalistic attitude (which characterizes the natural sciences) and the personalistic attitude (which characterizes the human sciences). I then consider the notion of the natural attitude and argue that the personalistic attitude represents the systematic core of it. The natural attitude may be defined as the human attitude, i.e., as the attitude in which subjects posit themselves exclusively as human subjects belonging to the world , which is itself unceasingly posited as being. In the final part of the paper I explore the function of the phenomenological reduction insofar as it opens up a possibility of self-understanding that breaks with the natural, human self-apprehension and discloses subjectivity in its transcendental dimension. This opens up a radically new attitude, the phenomenological, which should not be confused with a first-person perspective within the framework of the natural attitude. (shrink)

We characterize Hegel’s stance on biological purposiveness as consisting in a twofold move, which conceives organisms as intrinsically purposive natural systems and focuses on their behavioral and cognitive abilities. We submit that a Hegelian stance is at play in enactivism, the branch of the contemporary theory of biological autonomy devoted to the study of cognition and the mind. What is at stake in the Hegelian stance is the elaboration of a naturalized, although non-reductive, understanding of natural purposiveness.

Modeling law search and retrieval as prediction problems has recently emerged as a predominant approach in law intelligence. Focusing on the law article retrieval task, we present a deep learning framework named LamBERTa, which is designed for civil-law codes, and specifically trained on the Italian civil code. To our knowledge, this is the first study proposing an advanced approach to law article prediction for the Italian legal system based on a BERT (Bidirectional Encoder Representations from Transformers) learning framework, which has (...) recently attracted increased attention among deep learning approaches, showing outstanding effectiveness in several natural language processing and learning tasks. We define LamBERTa models by fine-tuning an Italian pre-trained BERT on the Italian civil code or its portions, for law article retrieval as a classification task. One key aspect of our LamBERTa framework is that we conceived it to address an extreme classification scenario, which is characterized by a high number of classes, the few-shot learning problem, and the lack of test query benchmarks for Italian legal prediction tasks. To solve such issues, we define different methods for the unsupervised labeling of the law articles, which can in principle be applied to any law article code system. We provide insights into the explainability and interpretability of our LamBERTa models, and we present an extensive experimental analysis over query sets of different type, for single-label as well as multi-label evaluation tasks. Empirical evidence has shown the effectiveness of LamBERTa, and also its superiority against widely used deep-learning text classifiers and a few-shot learner conceived for an attribute-aware prediction task. The intellectual trajectories of social scientists Robert N. Bellah and Clifford Geertz are compared as a case study in the production of successful interdisciplinary work. Geertz and Bellah started from a similar position, in terms of scholarly habits, network centrality, and symbolic capital. However, while Geertz became an interdisciplinary star and left his mark in disciplines as diverse as history, sociology, and cultural studies, Bellah’s interdisciplinary appeal was more limited, while his ability to speak to the general public as a (...) public intellectual was unmatched by Geertz. We thus review Bellah’s and Geertz’s parallel careers using a multidimensional analytical model intended to complete current field-based and performative-pragmatist models of intellectual success, arguing that interdisciplinary success can be accounted for by a combination of local ecological factors, images of intellectual work, and texts showing a high degree of cross-disciplinary fluency. Perceptions of a firm’s stance on corporate social responsibility (CSR) are influenced by its corporate marketing efforts including branding, reputation building, and communications. The current research examines CSR from the consumer’s perspective, focusing on antecedents and consequences of perceived CSR. The findings strongly support the fact that particular cues, namely perceived financial performance and perceived quality of ethics statements, influence perceived CSR which in turn impacts perceptions of corporate reputation, consumer trust, and loyalty. Both consumer trust and loyalty were also (...) found to reduce the perceived risk that consumers experience in buying and using products. From these significant findings, we draw several conclusions and implications, including the importance of enhancing firm focus toward its ethical commitment and long-term reputation. (shrink)

This article reconstructs and defends Husserl's argument for the indubitability of the existence of the world as grounded in ultimate principles. Responding to criticisms about the feasibility of a Husserlian‐informed metaphysical cosmology, it offers a systematic account that explores the question of the world's existence at three distinct levels (factual‐empirical, eidetic, and transcendental), leading to a threefold characterization of the world. First, the obviousness of the world's existence serves as our point of departure. The analysis then moves from a conception (...) of the world as (i) an ontic factum and pregiven ground of all theoretical and practical endeavors in the natural attitude, to a priori ontological considerations of (ii) the essence of “world in general.” However, the insufficiency of both factual‐empirical and a priori investigations necessitates a further displacement of the analysis into the transcendental field of pure phenomena. In accordance with the fundamental principle of synthesis, the world is thus reconceived of as (iii) a phenomenological factum. In this context, the clarification of the existence of the world as both an irrational and a “rational” fact provides all the elements necessary to demonstrate the relative apodicticity and empirical indubitability of the world. Dispositional Realism is the view according to which some denizens of reality – i.e., dispositions – are properties, that may exist in the natural world and have an irreducible modal character. Among Dispositional Realists, Charlie Martin, Ullin Place and George Molnar most notably argued that the modal character of dispositions should be understood in terms of their intentionality. Other Dispositional Realists, most notably Stephen Mumford, challenged this understanding of the modal character of dispositions. In this paper, I defend a fresh (...) version of the intentional understanding of dispositions. I start by distinguishing two questions about properties, respectively addressing their identity conditions and their individuation conditions. I, then, define categorical and dispositional properties in terms of their qualitative character, and examine their identity and individuation conditions. I conclude that the attribution of intentions is a conceptual tool: it was introduced in order to help specifying the conditions of individuation of a disposition; however, such attribution does not affect the identity of a disposition. Recent feminist accounts of autonomy have focused both on autonomous agents’ relationships to others and on their self-regarding attitudes or self-relations. This chapter focuses on the attitude of practical self-care, arguing that autonomous agents must care about themselves in a sense that amounts to caring about their practical reasons. While self-care is primarily a self-relation, it also implies a form of interpersonal relationality. Caring about one’s reasons requires caring about intersubjective assessments thereof, and the relation of self-care thus implies openness (...) to the reasons of others and a disposition to hold oneself answerable for one’s identity-constituting concerns. This work formalizes an informant-based structured argumentation approach in a multi-agent setting, where the knowledge base of an agent may include information provided by other agents, and each piece of knowledge comes attached with its informant. In that way, arguments are associated with the set of informants corresponding to the information they are built upon. Our approach proposes an informant-based notion of argument strength, where the strength of an argument is determined by the credibility of its informant agents. Moreover, we (...) consider that the strength of an argument is not absolute, but it is relative to the resolution of the conflicts the argument is involved in. In other words, the strength of an argument may vary from one context to another, as it will be determined by comparison to its attacking arguments (respectively, the arguments it attacks). Finally, we equip agents with the means to express reasons for or against the consideration of any piece of information provided by a given informant agent. Consequently, we allow agents to argue about the arguments’ strength through the construction of arguments that challenge (respectively, defeat) or are in favour of their informant agents. (shrink)

Phenomenology has been defined by Husserl as “theory of the essences of pure phenomena,” yet the ontological status of essences in Husserlian phenomenology is far from a settled issue. The late Husserlian emphasis on genetic constitution and the historicity of the lifeworld is not immediately reconcilablewith the ‘unchangeable’ nature that is prima facie attributed to essences. However, the problem of the nature of ideality cannot be dropped from phenomenological accounts without jeopardizing the phenomenological enterprise as such. Through an immanent analysis (...) of Husserl’s meditation on essences a positive account of their ontological status is provided. Essences are interpreted as ontological thresholds, primordially rooted in our motivated confrontation with sensuous transcendence. Essences appear as emergent ontological features, which are not reducible to their particular realizations and which exhibit a fundamental continuity between consciousness and being. They manifest themselves as prospectively a priori (a precondition for further experiences), but retrospectively a posteriori (they are founded in experience). Finally, essences manifest the ‘co-essential’ nature of consciousness and sensuous transcendence: they are the way in which we are motivated and constitutively bound to articulate being, which in turn is apt to be thus articulated. En este estudio analizamos recursos conceptuales alternativos a los que se han delimitado desde el marco de cognición dominante que configuró el canon académico occidental tradicional, para resignificar nuestras prácticas epistémicas y de subjetivación, con el objetivo de reconocer y legitimar, dentro de las narraciones acerca del conocimiento, las experiencias de identidades disidentes frente a la hegemonía. Para ello, examinamos cómo los espacios de producción de conocimiento normativos han mantenido una semiótica cerrada excluyendo los saberes de subjetividades periféricas. En este (...) contexto, acudimos a las propuestas de la comprensión encarnada y el conocimiento situado para entablar diálogos encarnados-situados desde los que ofrecer perspectivas alternativas y críticas respecto a las prácticas epistémicas. Desde estos diálogos, estudiamos la cuestión de la subjetividad a través de la idea de diferencia para ofrecer horizontes más flexibles y abiertos respecto a la configuración identitaria, en un sentido tanto individual como colectivo. This article, divided into two parts, traces and discusses two pairs of analogies invoked in Sanskrit literature to articulate the paradox of God’s oneness and multiplicity vis-à-vis the souls and the manifest world, reflecting the philosophical positions of pariṇāmavāda and vivartavāda. These are, respectively, the analogies of fire in wood and dairy products in milk, and moon/sun in pools of water and space in pots. In Part I, having introduced prevalent ideas about the status of the supreme principle vis-à-vis creation (...) in Śaivism, Sāṅkhya, and Vedānta, I investigate instances of the first pair of analogies in multiple textual genres, and especially in Śaiva literature from South and Southeast Asia, to highlight the influence of pariṇāma-Vedānta on the Śaiva textual corpus. Arguing that the distribution of the two pairs of analogies may cast some light on the relationship between different strands of dualistic and non-dualistic scriptures, I propose that the first pair could be traced back to the “formative” period of Śaivism—that is, prior to the emergence of the fully dualistic Śaiva Saiddhāntika corpus known to us. In their article ‘Who is afraid of black box algorithms? On the epistemological and ethical basis of trust in medical AI’, Durán and Jongsma discuss the epistemic and ethical challenges raised by black box algorithms in medical practice. The opacity of black box algorithms is an obstacle to the trustworthiness of their outcomes. Moreover, the use of opaque algorithms is not normatively justified in medical practice. The authors introduce a formalism, called computational reliabilism, which allows generating justified beliefs on the (...) algorithm reliability and trustworthy outcomes of artificial intelligence systems by means of epistemic warrants, called reliability indicators. However, they remark the need for reliability indicators specific to black box algorithms and that justified knowledge is not sufficient to justify normatively the actions of the physicians using medical AI systems. Therefore, Durán and Jongsma advocate for a more transparent design and implementation of black box algorithms, providing a series of recommendations to mitigate the epistemic and ethical challenges behind their use in medical practice. In this response, I argue that a peculiar form of black box algorithm transparency, called design publicity, may efficiently implement these recommendations. Design publicity encodes epistemic, that is, reliability indicators, and ethical recommendations for black box algorithms by means of four subtypes of transparency. These target the values and goals, their translation into design requirements, the performance and consistency of the algorithm altogether. I discuss design publicity applying it to a use case focused on the automated classification of skin lesions from medical images. (shrink)

The study here is a qualitative research based on multiple case studies of banking service providers to analyze the role of corporate social responsibility (CSR) in the definition of the corporate identity of these kinds of organizations. The results show that, although companies increasingly integrate CSR into their business strategies, there are some aspects of its management such as its communication or the measurement of its results that detract from its success. These results have important implications for those managers pursuing (...) an effective management of CSR policies and strategies in their organizations, especially as the information comes from 6 of the biggest and most important banking institutions in a European country, with a declared assets (loans) volume which represents 62.75% of the total assets in the national banking industry, and thus largely representing the possible heterogeneity of the market in terms of company size, location, legal status, and management styles. In terms of ethical implications, Boers, van Delden and Bredenoord have made an interesting step forward with their model of organoids as hybrids, which seeks to find a balance between subject-like value and object-like value. Their framework aims to introduce effective procedures not to exploit donors and to increase their engagement, but it does not seem to take sufficient account of how organoids are used and how donors and society as a whole may want to act about such uses. I (...) will concentrate my remarks on three points that I consider relevant. The first comment concerns the so-called mini-brains. The second one is related to the issue of consent and long-term ‘control’ over the organic material granted by donors. The last comment focuses on ‘genetic minorities’. (shrink)

In recent works, Kind has argued that imagination is a skill, since it possesses the two hallmarks of skill: improvability by practice, and control. I agree with Kind that and are indeed hallmarks of skill, and I also endorse her claim that imagination is a skill in virtue of possessing these two features. However, in this paper, I argue that Kind’s case for imagination’s being a skill is unsatisfactory, since it lacks robust empirical evidence. Here, I will provide evidence for (...) by considering data from mental rotation experiments and for by considering data from developmental experiments. I conclude that imagination is a skill, but there is a further pressing question of how the cognitive architecture of imagination has to be structured to make this possible. I begin by considering how can be implemented sub-personally. I argue that this can be accounted for by positing a selection mechanism which selects content from memory representations to be recombined into imaginings, using Bayesian generation. I then show that such an account can also explain. On this basis, I hold that not only is imagination a skill, but that it is also plausibly implemented sub-personally by a Bayesian selection mechanism. (shrink)

Eating local food has become a mainstream proxy for virtue and a reliable model of sustainable dieting. It suffers, nonetheless, from genuine criticisms and limitations. In this paper, we suggest theoretical amendments to reorient the local food movement and turn eating local into a robust concept—comprehensive, coherent, and inclusive, affording a firm grip over structural aspects of the food chain. We develop our argument in three parts. The first contends that ‘local’ can be said of lots of entities (e.g. whole (...) or multi-ingredient foods, recipes, menus) and that its meaning varies depending on which entities are under consideration. The second examines three dimensions of being local: the distance from the place of production; the geographical origins; the social links to consumers and producers. The third presents our robust conception of eating local, grounded on a more realistic model that accommodates for heterogeneous and complex actors. (shrink)

Alethic pluralism holds that there are many ways of being true. The view has been accused of being unable to do justice to the traditional account of logical validity, understood as necessary truth preservation. In this paper I reformulate the debate in terms of the naturalness of generic truth, and discuss some notable consequences of this more careful reformulation. I show not only that some alleged solutions, like the resort to plural quantification, are ineffective, but also that the problem is (...) not really posed by mixed inferences, as usually thought. Finally, I argue that the traditional account of logical validity does carry a commitment to generic truth, so that a strong version of alethic pluralism can hardly vindicate it. (shrink)

In sharp contrast with Socratic logoi, Eleatism, far from promoting philosophy (protreptic), eventually alienates all possible disciples ('apotreptic'), thus undermining the very (...) notion of Platonic philo-sophia. This paper claims that there is a plausible sense in which validity is a matter of truth preservation relative to interpretations of the sentences that occur in an argument, although it is not the sense one might have in mind. §1 outlines three independent problems: the first is the paradox of the sorites, the second concerns the fallacy of equivocation, and the third arises in connection with the standard treatment of indexicals. §2 elucidates the claim about validity, while §§3-5 show (...) how the three problems outlined can be handled in accordance with it. §6 explains how the claim squares with the traditional idea that validity is related to formality, and in particular with a broadly accepted definition based on that idea, the model-theoretic definition of logical consequence. Unlike other works on the subject, this paper does not focus on necessity. It is not its intention to provide a characterization of necessity that conforms to some ideal of rigour or to some pre-theoretical understanding of validity. El trabajo se propone pensar el estatuto de la técnica en el marxismo operaísta y postoperaísta y los objetivo que tiene son tres. En primer lugar mostrar cómo una concepción de la técnica que podemos definir como anti instrumental, sobre todo en virtud del postulado de anti-neutralidad valorativa que acarrea, subyace a los planteamientos operaístas. En segundo lugar elucidar cómo esta perspectiva constituye una línea de continuidad entre el primer operaísmo y los trabajos contemporáneos de autores postoperaístas como Negri y (...) Virno. En tercer lugar plantear que un punto de ruptura conceptual importante entre el operaísmo y el «marxismo oficial» reside en la distintas formas de pensar el espacio en que se producen valores de uso. A partir de la diferenciación entre neutralidad metodológica y neutralidad fáctica postulada por Rapp, defenderemos que ambas perspectivas rechazan la neutralidad valorativa de los medios de producción, pero no piensan la neutralidad de la misma manera. The present study seeks to accomplish three goals: to shed light on the problem of reason in Husserl’s co-inherited philosophical project, to elucidate his transcendental critique of reason, and to present Husserl's idea of reason in its distinctive features. A historical excursus first provides a frame to understand the necessity of a critique of reason, its proper subject-matter, and its function for the project of genuine philosophy. In particular, this historical reflection identifies the form that a critique must assume in (...) order to fulfil its philosophical-scientific task. The focus is then directed at Husserl's methodological recalibration of the problem of reason. Husserl's ‘prinzipielle Kritik’ is elucidated in his transcendental reassessment of the headings ‘reason’ and ‘unreason,’ and is thought in connection to the concept of Selbstbesinnung. Lastly, Husserl’s idea of reason is reconstructed in relation to, and in disambiguation from, the concepts of self-evidence, logos, synthesis, fulfilment, positing, etc. Reason, as teleological rule and structural form of transcendental subjectivity, is clarified in its dependence on, and irreducibility to, the problems of constitution and in light of the question of its objective/subjective character. The relationship between self-consciousness, Aristotelian ontology, and Cartesian duality is far closer than it has been thought to be. There is no valid inference either from considerations of Aristotle's hylomorphism or from the phenomenological distinction between body and living body, to the undermining of Cartesian dualism. Descartes' conception of the self as both a reasoning and willing being informs his conception of personhood; a person for Descartes is an unanalysable, integrated, self-conscious and autonomous human being. The claims that Descartes introspectively (...) encounters the self and that the Cartesian extent of inner space is self-contained are profound errors, distortions through the lenses of modern theories. This paper reviews the structure of standard quantum mechanics, introducing the basics of the von Neumann-Dirac axiomatic formulation as well as the well-known Copenhagen interpretation. We review also the major conceptual difficulties arising from this theory, first and foremost, the well-known measurement problem. The main aim of this essay is to show the possibility to solve the conundrums affecting quantum mechanics via the methodology provided by the primitive ontology approach. Using Bohmian mechanics as an example, the paper argues for a (...) realist attitude towards quantum theory. In the second place, it discusses the Quinean criterion for ontology and its limits when it comes to quantum physics, arguing that the primitive ontology programme should be considered as an improvement on Quine’s method in determining the ontological commitments of a theory. Recent discussions of self-realization have devolved into unscientific theories of self-help. However, this vague and often misused concept is connected to many important individual and social problems. As long as its meaning remains unclear, it can be abused for social, political, and commercial malpractices. To combat this issue, this book shares perspectives from scholars of various philosophical traditions. Each chapter takes new steps in asking what the meaning of self-realization is–both in terms of what it means to understand who or (...) what one is, and also in terms of how one can, or should, fulfilll oneself. The conceptual elucidations achieved from both theoretical and practical perspectives allow for a more mature awareness of how to deal with discourses on self-realization and, in any case, can help to demystify the subject. Clinical ethics committees (CECs) have been developing in many countries since the 1980s, more recently in the transitional countries in Eastern Europe. With their increasing profile they are now faced with a range of questions and challenges regarding their position within the health care organizations in which they are situated: Should CECs be independent bodies with a critical role towards institutional management, or should they be an integral part of the hospital organization? In this paper, we discuss the organizational context (...) in which CECs function in Europe focusing on five aspects. We conclude that in Europe clinical ethics committees need to maintain a critical independence while generating acceptance of the CEC and its potential benefit to both individuals and the organization. CECs, perhaps particularly in transitional countries, must counter the charge of “alibi ethics”. CECs must define their contribution to in-house quality management in their respective health care organization, clarifying how ethical reflection on various levels serves the hospital and patient care in general. This last challenge is made more difficult by lack of consensus about appropriate quality outcomes for CECs internationally. These are daunting challenges, but the fact that CECs continue to develop suggests that we should make the effort to overcome them. We believe there is a need for further research that specifically addresses some of the institutional challenges facing CECs. (shrink)

Street art and graffiti are on the rise and their problematic relationship with the law is becoming an increasingly pressing issue. This paper considers a series of high profile street art controversies involving famous street artists Banksy and Alice Pasquini as cases studies for illuminating such a relationship. First, by discussing the “Banksy’s Law” – a “law” protecting street artworks in the style of Banksy while condemning graffiti – and its perceived arbitrariness, I investigate what I call the structural differences (...) between aesthetic and legal judgments. While not denying some continuity in reasoning about the law and the arts, I argue that legal judgments possess a degree of formality that cannot be found in their aesthetic counterpart. Second, in expanding my discussion, I also maintain that aesthetic considerations should not function as overriding reasons in legal determinations. By being illegal, many street artworks and graffiti acquire subversive power. If deprived of the possibility of challenging the law because of their aesthetic value, these art forms would lose much of their political value. And, more generally, a world where artworks cannot challenge the law is a world where the arts are rather superficial forms of entertainment. (shrink)

In order to accommodate for the present shortage of oocyte donors, oocyte-donation programs place ads in college newspapers and provide large monetary compensation to encourage participation. Large compensation acts as a strong incentive for young women to undergo the potentially risky procedure of donation. In this enticing situation, it is particularly important for programs to fully inform prospective donors of the risks of the procedure so that they can accurately weigh the costs and benefits of donating. However, because oocyte-donor programs (...) must alleviate the shortage of donors if they wish to maintain a financially viable business, there is reason to fear that they may minimize or misrepresent risks when recruiting egg donors. In this pilot study, the risk information provided by programs (n=19) to prospective oocyte donors in a preliminary phone call inquiry was investigated. The majority of the programs provided incomplete and/or inaccurate risk information. Policy changes are recommended to reduce the potential for undue influence and to standardize and regulate the risk information provided to prospective egg donors. (shrink)

This paper advocates the importance of an ethical choice in the design of a given technology. As—among various possible examples—the history of the Internet shows, the intersection between trust, law, and technology can become either an empowering factor for business and individuals or a tool for infringing human rights. It is of utmost importance not to lose focus on the fact that every technology is a human byproduct, and that when a technology fails, it is mainly a human fault.

We are living in the era of street art. Since Nick Riggle’s pivotal work on the definition of street art, several philosophers have addressed issues in the philosophy of street art. The goal of this paper is to summarize the literature. I consider the following matters, which have been at the core of philosophical discussions on street art: demarcation, value, illegality, and the ethical foundation of intellectual property (IP) protection. In answering the question ‘What is street art?,’ philosophers have generally (...) resisted skeptical approaches by developing a wide range of real and essentialist definitions of street art (Section 2). When considering street art’s value, I distinguish between aesthetic and non-aesthetic centered accounts. If the former focus on the aesthetic side of our experience of street art, the latter generally place emphasis on its activist nature and political significance (Section 3). In discussing the relationship between street art and illegality, I canvas different takes on the issue. If for some scholars illegality is either a necessary or sufficient condition for street art, philosophers tend to agree that it is neither, while not denying its relevance at the level of identity and authenticity (Section 4). Finally, I consider matters of IP protection of street art. On the one hand, copyright optimists defend the view that current IP legislations may very well have a positive impact on the promotion and preservation of street art. Pessimists, on the other hand, argue that an extension of copyright privileges to works of street art is likely to jeopardize the counter-cultural and rebellious nature of this urban art kind (Section 5).
